These Terms and Conditions (“Terms”) govern your access to and use of TalkingPhotos.ai (the “Website,” “Platform,” “Service,” “we,” “us,” or “our”). By accessing or using the Service, you agree to be legally bound by these Terms. If you do not agree, you must immediately discontinue use of the Service.

1. Nature of the Service

TalkingPhotos.ai provides artificial intelligence–based technology that enables users to animate images, generate talking, singing, or motion-based videos, perform face or avatar swaps, synchronize audio, and apply motion-transfer techniques. TalkingPhotos.ai provides the technology only and does not create, control, review, or approve user content.

2. User Content and Responsibility

You are solely responsible for all images, videos, audio, prompts, text, and other materials you upload, submit, generate, or distribute through the Service (“User Content”). You represent and warrant that you own or have obtained all necessary rights, permissions, and consents for all User Content and resulting outputs.

3. AI-Generated Content Limitations

• Generated outputs may be inaccurate, incomplete, or unintended
• Outputs are not guaranteed to be unique
• Outputs may resemble other generated or publicly available materials

TalkingPhotos.ai makes no representations regarding originality, accuracy, legality, or non-infringement of generated outputs.

4. Replicate (Motion Transfer) Feature

The Replicate feature applies generalized motion, movement, timing, or positional data from a user-provided reference video to a newly generated video featuring a different actor or subject. Only abstract motion characteristics are processed. No identity, likeness, facial features, voice, branding, choreography, or copyrighted expression from the reference video is copied or reproduced.

You retain full responsibility for reference videos and resulting outputs and must not use reference media unless you have lawful rights and authorization to do so.

5. Face Swap, Avatar Swap, and Likeness Use

You must not upload or generate content using the likeness, face, or appearance of any real person without lawful authorization. Use of celebrity, public-figure, or recognizable individual images or videos is strictly prohibited unless you have explicit legal consent.

6. Voice and Audio Integration

If you use voice, text-to-speech, or cloned-voice features (including integrations with third-party services), you are solely responsible for ensuring lawful use and consent. TalkingPhotos.ai does not verify voice ownership or authorization.

7. Prohibited Uses

• Impersonation, deception, or misleading content
• Violation of privacy, publicity, or intellectual property rights
• Political persuasion, election interference, or misinformation
• Illegal, abusive, hateful, or exploitative content
• System abuse, automation, scraping, or circumvention of limits

8. Account Enforcement

We reserve the right, in our sole discretion and without notice, to suspend, restrict, or terminate accounts that violate these Terms, pose legal or reputational risk, or abuse the Service. Termination does not entitle you to refunds or compensation.

9. Intellectual Property

All rights, title, and interest in the Service, software, AI models, and underlying technology belong to TalkingPhotos.ai or its licensors. Unauthorized resale, sublicensing, or reverse engineering is strictly prohibited.

10. DMCA and Repeat Infringer Policy

We respect intellectual property rights and reserve the right to remove content and terminate accounts of users determined to be repeat infringers, in our sole discretion.

11. Disclaimer of Warranties

The Service is provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind, express or implied.

12. Limitation of Liability

To the maximum extent permitted by law, TalkingPhotos.ai shall not be liable for any direct, indirect, incidental, consequential, or special damages arising from your use of the Service or generated content.

13. Indemnification

You agree to indemnify, defend, and hold harmless TalkingPhotos.ai and its owners, affiliates, officers, and employees from any claims arising out of your use of the Service or User Content.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Canada, without regard to conflict-of-law principles.
