1. Technology Provider Only

TalkingPhotos.ai (“TalkingPhotos.ai,” “we,” “us,” or “our”) provides software and artificial intelligence tools that enable users to create and edit content, including but not limited to image animation, talking/singing videos, lip-sync, motion-transfer, face/actor swaps, and related outputs (“Outputs”). We provide the technology only. We do not provide legal advice, clearance services, or rights verification.

2. User Responsibility for All Content

You are solely responsible for (i) all materials you upload, submit, or otherwise provide to the platform (“Inputs”), (ii) all Outputs generated using the platform, and (iii) any use, publication, distribution, advertising, or other exploitation of Inputs or Outputs. You are responsible for obtaining all necessary rights, permissions, releases, and consents (including copyright, trademark, publicity, privacy, and performance rights).

3. No Monitoring; No Endorsement

We do not routinely review, pre-screen, monitor, approve, or verify Inputs or Outputs for legality, accuracy, non-infringement, or compliance. Any examples, templates, or suggested uses are provided for informational purposes only and do not constitute approval or endorsement of any particular use case.

4. No Professional Advice

5. AI Limitations; No Guarantee of Uniqueness or Accuracy

Due to the nature of generative systems, Outputs may be inaccurate, incomplete, misleading, offensive, or may resemble other content. We make no representations or warranties that Outputs are unique, correct, lawful, non-infringing, or fit for any particular purpose.

6. Identity, Likeness, and Celebrity Restrictions

You must not upload or use images, videos, audio, or other materials of celebrities, public figures, or other identifiable individuals unless you have explicit legal authorization. You are solely responsible for ensuring that any depiction, impersonation, or likeness usage is lawful and properly authorized.

7. Replicate (Motion Transfer) Feature – Disclosure

The Replicate feature applies generalized motion, movement, timing, or positional data derived from a user-provided reference video to a newly generated video featuring a different actor or subject. Only abstract motion characteristics are processed. No identity, likeness, facial features, voice, branding, or copyrighted expression from the reference video is copied or reproduced by the tool.

You are solely responsible for all reference media you submit and for ensuring you have the rights and permissions to use such media and to distribute the resulting Outputs.

8. Third-Party Services and Links

The Service may integrate with or link to third-party services (e.g., hosting providers, payment processors, social media platforms, or AI providers). We are not responsible for third-party services, their availability, content, policies, pricing, or actions. Your use of third-party services is governed by their terms and policies.

9. DMCA / Copyright Complaints and Repeat Infringer Policy

We respect intellectual property rights. If you believe content on the Service infringes your copyright or other intellectual property rights, you may contact us at support@talkingphotos.ai with sufficient detail to identify the allegedly infringing material and your rights claim.

We reserve the right to remove or restrict access to content and to terminate accounts of users determined to be repeat infringers, in our sole discretion, and to take any other actions we deem appropriate to comply with applicable law and protect the Service.

YOU ASSUME FULL RESPONSIBILITY FOR YOUR USE OF THE SERVICE AND ALL RESULTING CONSEQUENCES.
